August 25, 2023 Results of Solicitation for Opinions on Draft of Partial Amendments to Examination Standards Related to the Radio Act for the System of Radio Operator in Full Charge

The Ministry of Internal Affairs and Communications (MIC) prepared a draft directive to partially amend the Examination Standards related to the Radio Act (MIC Official Directive No. 67 of 2001) to expand the System of Radio Operators in Full Charge. Accordingly, MIC solicited opinions from Wednesday, June 7 through Friday, July 7, 2023.
As a result, six opinions were submitted.
MIC will promptly amend the official directive based on the results of the opinion solicitation.

1. Overview of proposed amendments

Currently, concerning radio operators in full charge as indicated in Article 39, Paragraph 3 of the Radio Act (Act No. 131 of 1950), the Examination Standards related to the Radio Act (hereafter referred to as the “Examination Standards”) stipulate “Elements of Supervision of Radio Operator in Full Charge,” requires “presence” or “stationing” as a concept similar to “on-site participation” except under certain conditions.
MIC has considered amending the Examination Standards in compliance with the government’s Digital Principles. As a condition that does not require radio operators in full charge to be stationed as is shown in “immediacy” under “Elements of Supervision of Radio Operator in Full Charge,” MIC will add “when the radio operator can grasp the situation at the site to the same degree as if they were stationed.”

2. Future plans

The Official Directive will be amended as soon as possible based on the opinions received.
