August 9, 2023 Results of Solicitation for Opinions on Draft Ministerial Ordinance for Specified Business Operators of MIC-related Social Infrastructures, based on the Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from Thursday, June 15, 2023 through Friday, July 14, 2023 regarding a draft ministerial ordinance on specified business operators of MIC-related social infrastructures, based on the Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures. As a result, six opinions were submitted, and MIC has decided to disclose both the submitted opinions and its views on them publicly.

1. Overview

The Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures (Act No. 43 of 2022, hereafter referred to as the “Act on the Promotion of Economic Security”) shall partly come into effect from the date specified by a Cabinet Order within a period not exceeding one year and six months from the date of promulgation. MIC will now formulate the Ministerial Ordinance for Specified Business Operators of MIC-related Social Infrastructures based on the Act on the Promotion of Economic Security. This ministerial ordinance will develop the relevant provisions necessary to implement a part of the Act on the Promotion of Economic Security to ensure the stable provision of key infrastructure services, thereby defining the criteria for the designation of specific social infrastructure operators and critical facilities.

2. Results of solicitation for opinions

MIC drafted the Ministerial Ordinance for Specified Business Operators of MIC-related Social Infrastructures based on the Act on the Promotion of Economic Security. Following the Administrative Procedure Act (Act No. 88 of 1993), the solicitation for opinions was held from Thursday, June 15, 2023 through Friday, July 14, 2023.
As a result, MIC received six opinions. The submitted opinions and MIC’s views on them are shown in the attached PDF.

3. Promulgation and enforcement of the Ministerial Ordinance

Based on the results of the solicitation for opinions, etc., MIC has promulgated the ministerial ordinance today.
