September 22, 2023 Results of Solicitation for Opinions on Draft Amendments, including Draft Ministerial Ordinance to Partially Amend Ministerial Ordinance Regulating Radio Equipment and Report from Radio Regulatory Council Institutional development for reviewing technical standards and test methods for 2.4 GHz band wireless LAN, etc.

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from Saturday, July 1 through Monday, July 31, 2023, on a ministerial ordinance establishing technical standards and a notice establishing characteristic test methods to enable the use of European and US standard test data by reviewing the technical standards and test methods for 2.4 GHz band wireless LAN, etc. As a result, six opinions were submitted, and MIC decided to open the opinions to the public, along with MIC’s views on the opinions.
With consideration of the results of the solicitation for opinions, the draft ministerial ordinance to partially amend the Radio Regulating Radio Equipment Rules (Radio Regulatory Commission Rules No. 18 of 1950) was referred to the Radio Regulatory Council (chaired by SASASE Iwao, Professor Emeritus at Keio University) today, which reported that it found the draft appropriate.
MIC will promptly establish the relevant regulations based on the results of the solicitation for opinions and the report from the Radio Regulatory Council.

1. Background and Amendments Overview

In March 2022, MIC organized a Study Group on the Use of Test Data based on the US and European Standards for Wireless LAN Systems, and the Study Group compiled a report on the review of technical standards and test methods for 2.4 GHz band wireless LAN systems.
Based on this report, the solicitation for opinions was conducted from Saturday, July 1 through Monday, July 31, 2023, on the draft ministerial ordinance, partially amending the Ordinance Regulating Radio Equipment and other related regulations.

(1) Draft Ministerial Ordinance for Partial Amendments to the Ordinance Regulating Radio Equipment (Radio Regulatory Commission Rules No. 18 of 1950)
(2) Draft Notice for Partial Amendments to the MIC Notice No. 88 of 2004 (testing procedures for specified radio equipments)

3. Report from Radio Regulatory Council

Based on the results of the solicitation for opinions, MIC consulted the Radio Regulatory Council today on the draft ministerial ordinance amending part of the Ordinance Regulating Radio Equipment and received a report to the effect that the draft is appropriate.

4. Future plans

Based on the results of the solicitation for opinions and the report from the Radio Regulatory Council, MIC plans to improve the relevant provisions promptly.
