October 9, 2024 Administrative Guidance, etc., on Specified Radio Equipment Manufactured and Sold by FCNT LLC

 The Ministry of Internal Affairs and Communications (MIC) discovered that FCNT LLC (President: TANAKA Michitaka, Corporate Number 3021003013612, Head Office: Yamato City, Kanagawa Prefecture) had violated its obligation to conform to construction design under the Radio Act (Act No. 131 of 1950) concerning certain specified radio equipment manufactured and sold by the company. Today, we rendered administrative guidance to the company, a certified dealer, to take necessary actions, including measures to prevent recurrence.

1. Case Overview

 It was found that the mobile phone terminals manufactured and sold by FCNT LLC use an antenna to emit radio waves, which is not approved in the certified construction design.
 As a certified dealer, the company violated its obligation to conform to construction design as stipulated in Article 38-25 of the Radio Act.

2. Content of guidance

 The MIC today issued a strict warning to FCNT LLC, and instructed the company to investigate and analyze the cause of the problem, consider measures to prevent recurrence, and then report back to the MIC by Friday, November 8, 2024.
 For the mobile phone terminals in question, a new characteristics test based on the Radio Act was conducted. The results indicated that they now conform to the technical standards. As at Friday, September 13, 2024, the terminals have been certified based on the construction design. This indicates that the violations of the construction design conformity obligation for the relevant mobile phone terminals, including those that have already been distributed, have been rectified.
