November 15, 2024 Results of the Solicitation of Opinions on Draft Partial Amendments to the Regulations for Enforcement of the Radio Act - Clarification of the regulations concerning the provision of radio station information for investigations of interference or congestion -
The Ministry of Internal Affairs and Communications (MIC) solicited opinions from Saturday, September 28 to Monday, October 28, 2024, on a draft ministerial ordinance for partially amending the Regulations for Enforcement of the Radio Act with the aim of clarifying regulations concerning the documents that must be presented when requesting information on radio stations for investigations of interference or congestion of radio stations or for measures to promote the termination of such stations. Two opinions were submitted during the solicitation period, and MIC will accordingly publish the submitted opinions along with its views on them.
○ Background and overview
Under Article 25, paragraph 2 of the Radio Act (Act No. 131 of 1950), MIC provides information on radio stations to the extent necessary to those who wish to conduct investigations into interference or congestion that are required when establishing their own radio stations or changing frequencies, or those planning to take measures to promote the termination of stations, as prescribed in Article 27-12, paragraph 3, item 7 of the Radio Act. To prevent the misuse of the provided information for purposes other than those related to the investigations or termination measures, the Regulations for Enforcement of the Radio Act (Radio Regulatory Commission Rules No. 14 of 1950) stipulate that specific documents must be presented when requesting this information. MIC solicited opinions on the draft ministerial ordinance for partially amending the Regulations for Enforcement of the Radio Act to clarify these regulations.
