July 26, 2024 Ruling on an Application from NTT DOCOMO, INC. pursuant to Article 35, Paragraph 3 of the Telecommunications Business Act - Connection of telecommunications facilities between NTT DOCOMO, INC. (hereinafter referred to as “NTT”) and Colt Technology Services Co. Ltd. (hereinafter referred to as “Colt”) -

 The Ministry of Internal Affairs and Communications (MIC) today issued a ruling on an application from NTT pursuant to Article 35, Paragraph 3 of the Telecommunications Business Act (Act No. 86 of 1984).
 The ruling that NTT seeks pertains to the amount that Colt should acquire for the connection of telecommunications facilities between NTT and Colt. The ruling states that this amount must be set below the sum of a reasonable cost and a reasonable profit under efficient management.

Background

 On Tuesday, January 31, 2023, NTT (President and Representative Director: MAEDA Yoshiaki) applied for a ruling to the Minister for Internal Affairs and Communications, based on Article 35, Paragraph 3 of the Telecommunications Business Act, alleging that negotiations between the parties regarding the connection with telecommunications facilities of Colt (Representative Director Japan: OE Katsuya) failed.
 For this application, the MIC consulted the Telecommunications Dispute Settlement Commission on Friday, March 22, 2024 regarding a draft ruling, pursuant to the provisions of Article 160, Item 1 of the Telecommunications Business Act. We received the Committee's report on Thursday, June 27, 2024.
 Based on the report, we made partial corrections to the draft ruling and issued the final ruling today.
