April 23, 2025 Results of Solicitation for Opinions on Draft Partial Amendments, etc. to the Notice Regarding the Designation of Specified Telecommunications Facilities based on the Telecommunications Business Act, and Partial Amendments to the Notice, etc.

　The Ministry of Internal Affairs and Communications (MIC) solicited opinions on the Draft Partial Amendments, etc. to the Notice Regarding the Designation of Specified Telecommunications Facilities based on the Telecommunications Business Act (Act No. 86 of 1984) from Thursday, February 13, 2025, to Friday, March 14, 2025. As a result, one opinion was submitted. Based on the results of the opinion solicitation, we will make partial amendments and additions to the Notice.

1. Overview

　Under the Telecommunications Business Act, if a Category I or II designated telecommunications facilities installer or its affiliated company merges with or otherwise integrates a non-affiliated specified telecommunications facilities installer, it must update its registration as a Category I or II designated telecommunications facilities installer within three months of the merger or similar event, as stipulated in Article 12-2 of the Act. Failure to do so will cease to have effect its registration. This requirement is intended to promote fair competition.
　This matter involves partial amendments and additions to the Notice regarding the designation of specified telecommunications facilities under the Telecommunications Business Act, based on the installation status of the facilities in FY 2023.

2. Results of solicitation for opinions

　The MIC solicited opinions on the amendments to the Notice from Thursday, February 13, 2025, to Friday, March 14, 2025, and received one opinion.
　Based on the results of the opinion solicitation, we will partially amend the designation of telecommunications facilities in Article 12-2, Paragraph 4, Item 2(b) of the Telecommunications Business Act, and add the designation of telecommunications facilities to Item 2(d) of the same paragraph.

3. Promulgation and enforcement of the Notice

　The Notice was promulgated and entered into force today.
