June 1, 2023 Results of Appeal for Opinions on Drafted Partial Revision of Notice related to Designation of Specific Telecommunications Facilities based on Telecommunications Business Act, along with Revised Notice

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from March 25 through April 24, 2023, on drafted partial amendments to the Notice related to the Designation of Specified Telecommunications Facilities based on the Telecommunications Business Act (Act No. 86 of 1984), but no opinions were submitted.

1. Overview

Under the Telecommunications Business Act, if a licensee or a licensed group company of a category I or II designated facility merges with another licensee of a specified telecommunications facility, the renewal of the telecommunications business registration is required, pursuant to Article 12-2, Paragraph 1, Item 2 of the Act, to promote fair competition.
This matter corresponds to the partial revision of the Regulations for Enforcement of the Telecommunications Business Act (MPT Ordinance No. 25 of 1985) and the Notice on the Designation of Category I Specified Telecommunications Facilities (MPT Notice No. 243 of 2001 (Designation of Telecommunications Facilities in accordance with the provisions of Article 33-1 of the Telecommunications Business Act and Article 23-2-1 of the Regulations for Enforcement of the Telecommunications Business Act)) promulgated on January 16, 2023. Based on this partial revision of the Regulations, the designation and cancellation of specified telecommunications facilities will occur, and MIC will partially revise the Notice accordingly (see Attachment (PDF)).

2. Results of solicitation for opinions

The solicitation for opinions regarding the revision of this Notice was conducted from March 25 through April 24, 2023, but no opinions were submitted.

3. Promulgation and enforcement of the Notice

The Notice will be promulgated today and will go into effect on June 16, 2023.
