January 19, 2024 Results of Appeal for Opinions on Draft Partial Amendments to Notice related to Designation of Specified Telecommunications Facilities based on Telecommunications Business Act and Partial Amendments to Said Notice

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from Wednesday, November 1 through Thursday, November 30, 2023, on a draft to partially amend the Notice related to Designation of Specified Telecommunications Facilities based on Telecommunications Business Act (Act No. 86 of 1984). However, no opinions were submitted.

1. Overview

Under the Telecommunications Business Act, in the interest of promoting fair competition, when a Category I or Category II designated telecommunications facility licensee or its affiliated company merges with a non-affiliated entity that operates a specified telecommunications facility, the merger or other such events require the renewal of their telecommunications business registration, as stipulated in Article 12-2 of the same act. Failure to renew the registration within three months from the date of the merger results in the loss of the validity of the license.
This matter involves a partial amendment to the Notice concerning the designation of specified telecommunications facilities under the Telecommunications Business Act, taking into account the installation status of the facilities in fiscal year 2022 (see the attachment).

2. Results of solicitation for opinions

The solicitation for opinions regarding the amendments to the Notice was conducted from Wednesday, November 1 through Thursday, November 30, 2023, and no opinions were submitted.

3. Promulgation and enforcement of the Notice

The Notice was promulgated and went into effect today.
